INDIANA MINE SUBSIDENCE CHANGES - HOMEOWNERS, FARMOWNERS AND DWELLING PROPERTIES 
Senate Bill 336, which takes effect on January 1, 2017, amends the Indiana Code with regard to mine subsidence coverage. The bill removes the requirement that mine subsidence be caused by the collapse of inactive coal mines abandoned before August 3, 1977 and also removes the exclusion of public buildings from the definition of structure. The bill adds a requirement for limited additional living expense coverage in the event the insured is displaced as a result of damage caused by mine subsidence to the covered structure in which the insured resides. The additional living expense coverage is not required if it is provided by the underlying policy or waived by the insured.  Where applicable, the limit of additional living expense coverage is $15,000 with a $5 premium.

No action is required by agents on policies due to this change.  Any questions regarding the changes to these forms can be directed to your MAX Underwriter.
 
To address the changes introduced with this bill, the following form changes have been filed and approved effective January 1, 2017:
 
Homeowners:  The CL 0332 01 17 replaces the CL 0332 01 01.
Farmowners:  The CL 0336 01 17 replaces the CL 0332 01 01.
Dwelling Properties:  The FL 0332 01 17 replaces the CL 0332 01 01.
