“Affordable Housing in New Jersey: Is it a Right or a Privilege?”
 
As the cost of living continues to skyrocket nationally, New Jersey continues to contend with a lack of affordable housing. Since 1999, the state’s now defunct Council on Affordable Housing, enacted in response to the Mount Laurel Doctrine, failed to regulate or enforce affordable housing mandates. The lack of oversight ultimately led to a 2015 ruling by the New Jersey Supreme Court that mandated all affordable housing decisions have judicial oversight. As New Jersey seeks ways to provide affordable housing, it finds itself in a triangular conflict with real estate developers and local jurisdictions.
