Administrative Law Section's "WRITS!" is a Big Success

Sacramento, California - The Administrative Law section of the Sacramento County Bar Association hosted all of the writ judges of the Superior Court of Sacramento County at their February 13, 2013 luncheon entitled "WRITS!".  

Participating Judges included the 
Hon. Timothy M. Frawley, Hon. Michael P. Kenny, Hon. Allen H. Sumner, and Hon. Eugene L. Balonon.

Judge Frawley "MC-ed" the event, answering questions that were pre-submitted by Simas & Associates, Ltd. or posing them to his colleagues.  The questions were focused on two particular types of writs, the traditional writ of mandate pursuant to Code of Civil Procedure section 1085 and the writ of administrative mandate, pursuant to Code of Civil Procedure section 1094.5.  

"The questions directly addressed the judges' procedural and substantive preferences," explained Justin D. Hein, an attorney at Simas & Associates, Ltd.  "The answers also really shed some light on the backgrounds of these judges and where they are coming from in reviewing petitions and requests for stay.  For example, it is easy to forget that all of them are full-time criminal judges throughout the week.  So, they only have so much time to devote to any given motion or request."

"A lot of what was shared was not 'secrets'," explained Nicole D. Hanley, another attorney at Simas & Associates, Ltd.  "Rather, the judges are playing by the same rules found in the code and best practices guides.  However, the value came from having Judge Kenny explain his opinion on the importance of adhering to the rule and the real consequences it has had in his own courtroom."


Record Crowd at Administrative Law Section

It was a record crowd for an Administrative Law section luncheon, with well over 125 attendees, with a registration line that extended out to the parking lot.  The event went from 11:45 AM to 1:45 PM, with Judge Frawley continuing to answer questions and provide his perspective while walking out to head back to his jury trial.  And organizers Heather C. Hoganson and Steven L. Simas, officers of the section, could not have been happier with the event.

"Blue Prynt has done such a wonderful job in helping us host these events," stated Mr. Simas.  "So, I knew that it was on us to serve up something that the Admin Law section would really respond to.  I was thrilled, positively thrilled, when not one, or two, but all four writ judges agreed to participate and provide their time."  

"It was great to hear the judges' opinions and recommendations on how each of us can be more effective advocates for our clients," Mr. Simas continued.  "Equally fun was bumping into some old colleagues and swapping writ stories with a wider swath of the Sacramento administrative law community."

Presentation at Loomis Basin Veterinary Clinic

Loomis Basin Veterinary Clinic
On February 26, 2013, Steven L. Simas, Esq., founder and owner of Simas & Associates, Ltd., gave a presentation at the Blue Goose Event Center in Loomis, California.  The presentation was part of the Winter Lecture Series hosted by Loomis Basin Veterinary Clinic.

The topic of the presentation was “Veterinary Medical Records as Defense to Your Veterinary License”.  A powerpoint presentation can be accessed on Wit of Mandate, the official blog of Simas & Associates, Ltd.

Mr. Simas's next presentation will be done jointly with Justin D. Hein, Esq. on March 6, 2013 before the San Mateo County Commission regarding the Intersection of Criminal and Administrative Law.

805 Report – Physicians Beware

California law requires certain peer review organizations responsible for reviewing the medical care of physicians to make reports regarding physicians to the Medical Board of California (“MBC”). And these reports can trigger MBC investigations and even professional license discipline.  This is the often misunderstood – but almost always detrimental – “805 Report.”

The report is named after Business and Professions Code § 805 which requires such reports.  While many physicians complete their entire medical careers without having an 805 Report, the consequences of such a report to the MBC can be devastating and are far reaching.  The MBC investigates them and can easily turn them into disciplinary actions. In fact, the peer review body often does the MBC’s work for it by investigating a patient care issue involving the physician.  The MBC can then easily turn the investigation's findings into charges of negligence or other forms of misconduct.
