San Luis Obispo Civil Service Commission
 
San Luis Obispo, California - Steve Simas, Founder and Owner of Simas & Associates, Ltd., recently completed an annual training of he San Luis Obispo County Civil Service Commission (Commission).  The training was regarding the history, purpose, process, and procedures of the Commission.  Simas & Associates, Ltd. has served as outside counsel for the Commission since 2012.
 

"In order to effectively advise the Commission," Mr. Simas explained, "I need to ensure that all of the members understand their individual and collective role.  The best way to do that is by providing an annual training regarding the Commission itself.  By learning the Commission's own history and the motivation behind its creation, the individual members better understand the goals behind it.  Then, they will have a better handle on how to effectively wield the different tools, processes, and procedures, as well as authority, available to it." 

The Commission oversees administration of San Luis Obispo County's Civil Service system. It is comprised of members appointed by the Board of Supervisors to serve four year terms. In this capacity, the Commission prescribes, interprets and enforces the Civil Service rules.  They hold regular, public meetings the fourth Wednesday of every month

"They serve a very important function in public employment," Mr. Simas continued.  "They uphold the meritocracy that we expect from the private sector.  And they do so by enacting clear rules and applying them consistently and fairly.  They also do so through hearing grievances and conducting disciplinary hearings for public employees. All of these aspects are set-up to ensure that the qualified obtain and remain in public employment."

The training took place in San Luis Obispo on January 23.  All members of the Comission attended as well as numerous San Luis Obispo County officials and representatives.  To assist in presenting the material, Mr. Simas and the staff at Simas & Associates, Ltd. put together a comprehensive powerpoint presentation reviewing key aspects of the training.  To review the powerpoint presentation, please click here.

"The training was a success," Mr. Simas stated.  "I had multiple attendees thank and praise me for the grounded explanation of the Commission and their function."

"Also, I cannot thank my staff enough for all of the help they provided," Mr. Simas concluded.  "Jimy and Rachelle helped out a lot in researching, proofing, and revising the materials that became the powerpoint.  It really added to the presentation for the attendees.  And it helped me stay on point as the presenter."

New Director of Sacramento Valley Paralegal

On January 23, Julianne Allen, Paralegal at Simas & Associates, Ltd., was sworn-in as a new Director-at-Large of the Sacramento Valley Paralegal Association (SVPA).  In this role, Ms. Allen will be the secondary representative for the SVPA at the National Federation of Paralegal Associations, attending conferences the Western State Regional Conference in Seattle, WA, and the 2013 Convention in Hartford, CT.  She will also be taking over as Editor of The Journal - the bimonthly newsletter of the SVPA.

Congratulations, Julianne!  The SVPA is lucky to have such a bright, hardworking professional representing it and coordinating their newsletter.  We are sure you will do great.

Challenging Administrative Agency Actions through Writs of Mandate
 
One of the great mysteries of administrative law is how to challenge a decision or action by an administrative agency once the agency has completed theadministrative process or refused to act. Whether the agency has completed anadministrative hearing or simply refuses to follow one of its legal obligations, the tool of the administrative law trade to challenge these agencies is called a petition for a writ of mandate.

Exhaustion of Remedies

Doctrine of law that requires that procedures established by statute, Common Law, contract, or custom must be initiated and followed in certain cases before an aggrieved party may seek relief from the courts. After all other available remedies have been exhausted, a lawsuit may be filed.

Most commonly, exhaustion of remedies applies where an Administrative Agency has been established by the Legislature to handle grievances that occur under its purview. Only after the parties have satisfied each requirement of the grievance process, and the Agency has reached its final decision, can they appeal the decision to a higher tribunal.

The rationale behind requiring parties to exhaust their administrative remedies is that the agencies have the specialized personnel, experience, and expertise to sort and decide matters that arise under their jurisdiction. Also, the doctrine of Separation of Powers dictates that an agency created by the legislature should be allowed to carry out its duties without undue interference from the judiciary.
