CaRVTA Legal Hotline

Sacramento, California - Since 2012, Simas & Associates, Ltd. has offered all members of the California Registered Veterinary Technician Association (CaRVTA) their own advice hotline. By contacting our office at 888-999-0008, we can answer questions that CaRVTA members may have, from Administrative Law and Professional Licensing Law, to matters involving general Business LawEmployment Law, and Contract Law.  The first 30 minutes are free and discounted legal rates are offered upon formal retention.

 

Simas & Associates, Ltd. has served as CaRVTA's general counsel since its inception in 2008.  In that role, it has helped guide it through its growth and formalization.  It also assists a number of Veterinarians and RVTs as well on an individualized basis, being a leader in Veterinary Medicine Law with an extensive practice before the California Veterinary Medicine Board.  However, its practice is quite broader, helping professionals with any number of legal matters that may arise in the formation of a business, employment disputes, and drafting contracts.

Simas & Associates, Ltd. and Staff Participates in the Angel Tree and Next Move Adopt-a-Family Programs for the Holiday Season

The best part of the holidays is how many people do what they can to spread the joy to as many as possible in the community.  This ensures that the less fortunate or those in need gain a bit of reprieve and can be swept up by the magic of the season.  The goal is to provide a memorable experience for as many people and their children in need in the community as possible.

In order to do its part, the staff at Simas & Associates, Ltd. is participating in the Angel Tree Program, sponsored by The Salvation Army and CBS13/CW 31.  Arden Fair Mall, Sunrise Mall, Westfield Downtown Plaza, and Country Club Plaza Mall are coordinating the program by putting Angel Trees inside those shopping centers. Shoppers can then go up to the tree and pull a tag that will state the child's gender, age, and toy preference. Shoppers can bring back an unwrapped toy to the designated Angel Tree location and drop off the donated item.  Simas & Associates, Ltd. will be collecting toys from staff members and making its donation through December 13.

The toys will then be given to needy children during the Army's Annual Christmas Distribution on December 22nd and 23rd at Cal Expo.  Through the generosity of the community, more than 5,000 families received food and toys during last year’s holiday season.

In addition, the staff at Simas & Associates' Ltd. is participating in the Sacramento Valley Paralegal Association's (SVPA) adoption of a family through Next Move's Adopt-a-Family Program. Julianne Allen, Board Member of the SVPA, will be collecting toys from staff members through December 20.

California State Parks Celebrate 150th Anniversary of the State Park System

California State Parks officially launched the 150th Anniversary of State Parks earlier this month, along with the grand opening of California’s Statewide Museum Collections Center in McClellan Park, an event sponsored by the California State Parks Foundation (CSPF). 

In 1864, in the midst of the Civil War, President Abraham Lincoln signed legislation granting the Yosemite Valley and the Mariposa Big Tree Grove (known as the Yosemite Grant) to the state of California to be “held for public use, resort, and recreation, and shall be inalienable for all time”. In September of that year, California Governor Frederick Lowe accepted the grant and appointed the first State Parks Commission. Galen Clark, was appointed State Guardian of Yosemite in May 1866, at a salary of $500 per year, becoming the first State Parks employee. These actions represented not only the birth of California State Parks, but in essence, the birth of the national park idea, which has spread throughout the world.  

California State Parks has grown to be one of the largest state park systems in the world, with 280 park units, more than 1,600,000 acres, 14,000 campsites, and visitor attendance of some 70 million visitors per year.

“This is an exciting time for State Parks, as we will be commemorating our Sesquicentennial next year and looking ahead to the future of the system,” said Major General Anthony L. Jackson, USMC (Ret.), Director of California State Parks. “For 150 years, California State Parks has been a leader in the conservation and preservation of our natural and cultural resources, and our mission is to connect the people of California with their parks—whether it’s the beaches in southern California, or the Redwoods in the northern part of the State, or the historic and cultural parks and museums that are part of our history and our past.”

Complying with Workplace Labor Law Poster Requirements

In California, all employers must meet workplace posting obligations. Workplace postings are usually available at no cost from the requiring agency. The Department of Industrial Relations requires employers to post information related to wages, hours and working conditions in an area frequented by employees where it may be easily read during the workday.  If the company has multiple job sites or offices, then multiple posters have to be posted.
 
Employment laws can change at any time, and both California and federal laws require you to keep notices current. In fact, your business could incur significant fines for not posting the posters or for failing to update the posters.  Fines vary by poster and by enforcing agency, ranging from as low as $110 up to a potential maximum of $10,000.  For example, the failure to post the Federal OSHA Poster could result in a civil penalty of $7,000.00.  Similarly, the failure to post or update the California OSHA Poster could result in a penalty of $1,000.00.  In total, businesses that don’t post these required notices or post outdated information could face combined fines up to $17,000 per location.
