Marijuana – Take Two

posted by Lauren B. Feffer, Shareholder, Rosenbaum PLLC, March 20, 2019

On March 18, 2019, the governor signed the new medical marijuana changes into law. Currently known as Chapter 2019-1, the legislation expands upon the medical marijuana laws previously implemented. Of particular interest is that the revised laws now permit the smoking of medical marijuana to fall within the definition of “Medical use.” Read More

“I See You”: The Growing Demand To Install Video Doorbells In Multifamily Buildings

posted by Donna DiMaggio Berger, Community Association Law Blog, March 7, 2019
Security concerns are always at or near the top of the list of priorities in shared ownership communities. With personal home technology evolving at a dizzying pace, many homeowners are considering the installation of video doorbells such as those offered by Ring or Nest. Read more

Association Bills Abound at Start of 2019 Florida Legislative Session

posted by Laura Manning-Hudson, Florida HOA Lawyer Blog, March 15, 2019

As the 2019 Florida legislative session gets underway, all indications are that this will be a very busy year for new legislation affecting the more than 48,000 community associations in the state. Here are some of the bills that my fellow community association attorneys at our firm and I will be monitoring very closely: Read more

Board Can Regulate Alcohol on Common Property

posted by Joseph Adams, Florida Condo & HOA Law Blog, March 10 ,2019

The Florida courts have held that a board-made rule regulating use of common property must be “reasonable.” While this is a stricter test than the standard used to judge the provisions of your declaration of condominium, the courts do tend to defer to the “business judgment” of the board in deciding what is reasonable.  Read more

Board members and property managers of condominium communities need to be aware that the State of Florida’s Department of Business and Professional Regulation issued revisions to rules pertaining to violations and penalties, 61B-21, Condominium Resolution Guidelines for Unit Owner Controlled Associations, which went into effect December 5, 2018. Read more

The Project Costs What!?! That Requires A Membership Vote

posted by Marilyn Perez-Martinez, Florida Condo & HOA Law Blog, March 21,2019

It is of crucial importance that both owners and board members understand that just because a project carries a hefty price tag that does not make it subject to member approval.  Maintenance (which for purposes of this article includes repair and replacement work as well) of the common elements simply falls to the association no matter the cost. Note that I said maintenance rather than material alterations or additions. Read more

What is "Cumulative Voting" and Is It Permissible?

posted by Joseph Adams, Florida Condo & HOA Law Blog, March 24,2019

Under cumulative voting, each member is provided with one vote for each seat open on the board and may split those votes as he or she sees fit, including casting all votes for only one candidate. Cumulative voting gives a member’s vote more weight than if the homeowners’ association does not allow for cumulative voting. Read more

Rules on Drones All Community Associations Should Consider

posted by Roberto C. Blanch, Florida HOA Lawyer Blog, March 21, 2019

Drones have become extremely popular for those who yearn for the latest gadgets and gizmos.  Many associations have already adopted rules to address the use of drones in their communities, and those that have not done so should give it serious thought and consideration. Read more

Raffles and Games of Chance: A Gamble for Community Associations

posted by Kathleen O. Berkey, Florida Condo & HOA Law Blog, March 21,2019

Given the potential for condominiums, co-ops, and homeowners associations or its members to ask to conduct raffles, games of chance, or other forms of gambling (e.g., 50/50 raffle drawings, “horse racing,” and bucket raffles/Chinese auction) on common areas, it is important for community associations to understand state gambling laws and how they operate in the context of their communities. Read more

Names of Fellow Unit Owners Is Public Record

posted by Joseph Adams, Florida Condo & HOA Law Blog, March 3,2019

If your request for the names of each unit owner was made in writing, the association is legally required to make them available to you for inspection or copying within 10 working days after the association received your written request. If the request was not made in writing, there is not a similar legal requirement. Read more

April Tips

Shane's Spot: Begin any major landscaping changes this month

April is a great month to make any large landscaping changes you have had in mind, due mostly to the fact that you won't be dealing with the heat of the summer just yet. Some warm season plants you may consider adding to your garden this month are papaya and okra. As always, make sure that you plants are well watered every day.

As always, remember to install your sod green side up!
