Do Homeowners have a constitutionally protected right to use their property as a short-term rental?

posted by Dan Tiernan, COO, Campbell Property Management, January 29, 2020

Does your HOA or Condo have restrictions that prohibit owners from offering short-term rentals for their property?  Some legislators want to strip that right away from Condo and HOA owners in Florida. Many owners bought into their communities with the understanding that it would not operate like a hotel, but be occupied by other fellow owners. Here is a summary of what is happening on this subject. Read more

“WATER LEAKS IN YOUR CONDO: WHO’S RESPONSIBLE? | OPINION ,” MIAMI HERALD

posted by Donna DiMaggio Berger, Commuity Association Law Blog,  January 21, 2020

There are many advantages to living in a multifamily condo or co-op building in South Florida: great views, enviable locations and abundant amenities. However, there is always the possibility of water leaks. Not surprisingly, when these leaks occur, there is often an inherent tension and finger-pointing between the owner who suffers interior damage and the boards who are being asked to pay for repairs. Read more

Gated Communities have Fences; They can still offer a false sense of security

posted by Patrick Miller, CPP, Board Certified Security Consultant, Invictus Security, Janurary 30, 2020

For those Condominiums and Homeowner associations with Bulk Agreements, January is a great time to again review your Bulk agreements. It’s likely the association’s greatest budgeted expense and with resident needs changing, increased Internet use and streaming, and with your snowbird board members in town, it’s probably one of the best times of the year to get everyone on the board’s attention and participation as needed.  Read more

“Death of Candidate Does Not Require New Election,” News-Press

posted by Joseph E. Adams, Florida Condo & HOA Law Blog, December 30, 2019

The votes received for the deceased candidate would not be treated as void or invalidate the election. As of the deadline date for mailing out the ballots, there were seven qualified candidates. February Tips

Shane's Spot: Keep your plants looking good with fertilizer!

This is typically the last month of cool temperatures here in Florida, so continue to keep an eye on your plants if any more drops in temperature occur. February is also a great month to make an assessment of your plants for the upcoming spring season! To improve the color of your lawn, shrubs, and palms make sure to fertilize. Be conscious of how much you are watering your plants.

As always, remember to install your sod green side up!
