Who Do You Call? Fraud, Mismanagement and Rule-Breaking

posted by W.B. King, The South Florida Cooperator, October 2015

In most instances, the board or management team of a condo or HOA is equipped to handle the wide variety of issues that arise day-to-day, from a leaky roof to dealing with municipal bureaucracy. There are other, bigger issues—things like embezzlement and fraud, for example—that require experienced outside professionals to resolve. Read more

Foundational Documents for Co-ops, Condos and HOAs: Avoiding Document Disasters

posted by W.B. King, The South Florida Cooperator, October 2015

The building blocks of all homeowner’s associations are the community's respective bylaws, administrative documents and house rules. Equally important are legal documents that define critical information and other action items, such as terms of occupancy and procedures for the purchase and sale of units. If these legal documents are not expertly handled, or are outdated and vague, big problems can ensue. Read more

Association Regulations Can Lose Their Teeth If Not Enforced

posted by Joseph Adams, Florida Condo & HOA Law Blog, October 16, 2015

Enforcement of the governing documents is one of the most challenging areas for many homeowners’ associations. While most board members do not want to be perceived as the “bad guy” or the “HOA Police”, the fact is that if the association does not consistently enforce the restrictions contained in its governing documents, such restrictions become unenforceable. There is ample case law in Florida on point. Read more

November Tips

Keith's Corner: Watch Your Grass!

This month, monitor your grass for any brown patches that may come from fungal diseases. This may come from excessive irrigation and rainfall during the months when the temperature reaches below 80 degrees. It is important to adjust the irrigation system based on rainfall.  Plants need less watering in cooler weather. If your system does not have soil moisture sensors, you should consider turning off the system and only watering when necessary. November is also a great month to monitor your plants for any insects that may be harmful and to take the appropriate action to eradicate them.

As always, remember to install your sod green side up!
