Direct contact from claimants or legal representatives

Members should redirect any queries by a claimant or claimant’s solicitors in relation to a claim to MAV Insurance or, where a legal firm has been appointed by the scheme to act on behalf of the member, to that firm. This should occur whether proceedings are issued or not.

Risk management services update

A two-tier service approach will replace the biennial Liability Mutual Insurance (LMI) liability audit. This will align the LMI risk management services with the recent changes to the LMI premium calculation and provide a more tailored approach to member services.

Agreements with other parties requiring joint insurance

In a number of recent claims MAV Insurance has been required to seek contribution from the YMCA arising out of its day-to-day management obligations.

Protected Disclosure Act 2012

Read a summary of the key changes in protected disclosure legislation brought about by the introduction of the Protected Disclosure Act 2012 (Vic) which replaced the Whistleblowers’ Protection Act 2001 (Vic) on 10 February 2013.

Compliance with the Protected Disclosure Act was required by Victorian government entities by 11 August 2013.

MAV Insurance legal panel reappointed

The Victorian and Tasmanian legal panel was reappointed for three years after the recommendation was endorsed at the MAV Insurance Committee meeting on 23 August.

Fraud control in Tasmanian local government

The Tasmanian Audit Office has released its report on fraud control in local government. The audit involved six councils from across the state. It included criteria regarding anti-fraud culture (based on AS 8001-2008 Fraud and corruption control) and internal controls.

Playgrounds, risk and childhood development

A recent article in The Age, ‘Where the wild things play’, outlines the importance for children to be challenged during play. It echoes the presentation given by Play Australia to Victorian and Tasmanian members in 2012.

A tree-root management seminar will be held on Monday 21 October at the MAV, Melbourne. This is the first event in the 2013 Liability Mutual Insurance Seminar series. Further details will be released closer to the event.

VMIA Conference

The program for the Victorian Managed Insurance Authority’s (VMIA) has been released. MAV Insurance members can attend the conference, which will be held on 7 and 8 October at Hilton on the Park, Melbourne. Tickets for MAV Insurance members are $1100.

The annual Governance, Risk & Compliance Conference will be held from Wednesday 30 October to Friday 1 November at Crown Promenade, Melbourne. The Risk Management Institute of Australasia (RMIA) and the Australasian Compliance Institute are hosting this event. Early bird registration for RMIA members is $1945.
