August brings us the sun, at last, and some interesting HR topics.  Our first story outlines a case where an employee claimed constructive dismissal on the grounds of discrimination suffered by a colleague.  We move on to report the £10,000 fines faced by companies hiring illegal workers.  We report that we've drafted our first Settlement Agreement  - on the day they came into force, and finish up with a reminder of how to win a bottle of Champagne, on us!   The Diary section has some key events - you'll notice each month we'll let you know here the forthcoming staging dates for Pension Auto Enrolment.  Our Top Tip is about not missing opportunities - including our soon to be announced Free HR Surgery.  Finally, our Thought for the Day will strike a chord with the brilliant out there!

£27,000 won by man upset by racism suffered by colleague

Can an employee raise a claim of discrimination, even when they are not being directly discriminated against?  Yes, it's long been the case.  Mr Morgan brought a claim of constructive dismissal stating he could not continue to work in a racist culture.  The ET found in his favour and awarded him him more than £27,000 ..... read more here

Hiring an illegal worker - fines of up to £10,000 per worker

Businesses run the risk of fines of up to £10,000 for each illegal worker they hire, along with public naming and shaming by the UK Border Agency, while checking could leave you exposed to claims of discrimination.  Will "I didn't know" ever be a reasonable defence?  Find out here

Zero Hours Contracts - what's all the fuss about?

With zero hours contracts taking a bashing in the press, read our new blog where we suggest this could return us to the 'off the books' cash-in-hand days.

First Settlement Agreements drafted

Last month we had some good news reporting the benefit of confidentiality of pre-termination negotiations that come with the new  Settlement Agreements - in on 29 July.  Benefits are already being reaped since we've already drafted our fist Agreement and await (in line with the law) it's completion very soon.   Read more about them here ....

Here's what our Clients think of us ....

Donna has recently worked with us on a staff issue resulting in Dismissal and then an appeal. She was really supportive, giving us excellent advice and support. Her knowledge was extensive and accurate. She attended the appeal meeting and supported one of our directors though the minefield, that is HR law. I would have no hesitation recommending the services of Spirit HR which is unfortunately a service we all need from time to time if we employ staff.
